This was the third failed application attempting to develop the site. This statement is factually wrong and therefore misleading. The Judicial Review did not remit the decision back to the Council. The Judicial Review quashed the planning permission, due to "the mistake made by the officer in his report was, in its context and circumstances and in its possible consequence, sufficiently misleading to invalidate the committee's decision. It was "significantly" or "seriously" - misleading on a material matter, and it was left uncorrected before the decision was taken. In the context of the duty in section 66(1) of the Listed Buildings Act, the committee was misinformed on the consultation of a national amenity society.

Inclusion of the site in the DaSA Local Plan, contradicts policy EN5: Protecting Green Space.

The Proposed Submission document fails to state that the Land at Gullivers Bowls Club, Knole Road, Bexhill, is an established greenfield site. It has not been previously developed. It should therefore be removed from the Development and Site Allocations Local Plan.

This paragraph states that the buildings are in poor condition, yet it was established by a Land Tribunal hearing that the club is financially viable.

Since the developer abandoned plans to redevelop the site the club has, during 2018, been carrying out repairs to the club premises and improved the site surroundings.

As NPPF (6.47) directs development away from areas of highest flood risk and, when deciding planning applications, seeks to ensure that flood risk is not increased elsewhere, the suggestion that the Knole Road Site could be developed with a substantial number of hereditaments, immediately opposite the 4/5 storey Victorian listed terrace, with occupied basements, is clearly a contradiction.

SuDS (6.53) recognises the value of open space recreation and therefore the Knole Road site, in its entirety, should not be lost. It is stated under item 9 (p.38) that "potential increases in flood risk from urban development, land use change and climate change" is recognised in the requirement for sustainable drainage (SuDS) in accordance with Policy DEN5. Any loss of the green open space would impair surface water drainage in an area with a high water table resulting in frequent cellar flooding in surrounding properties.

As can be seen from the Policies Map Inset Map 1c (p.173): Bexhill Central, the areas of green open space are largely concentrated to the west of the town centre. Therefore the inclusion of the only green open space, marked BEX5, to the east of the town centre should not be considered for any residential development.
